These Terms of Service ("Terms") govern your use of the Grow South Africa website, platform and services, including memberships, the Business Registry, online Courses, the Road to Wellness and Prosperity Card programme, the Million Histories initiative, and our paid Tours and Events in South Africa. By creating an account, making a purchase, or making a booking, you agree to these Terms.
1. About us
Grow South Africa operates the website at growsouthafrica.co.za. You can contact us at matthys@growsouthafrica.co.za.
2. Eligibility
You must be 18 years or older to create an account, make a purchase, or book a Tour or Event. By using our services you confirm you meet this requirement and have the legal capacity to enter into a contract.
3. Your account
- You are responsible for all activity under your account and for keeping your password secure.
- The information you provide must be accurate and kept up to date.
- One account per person or business. Sharing accounts is not permitted.
- Notify us immediately at matthys@growsouthafrica.co.za of any unauthorised access.
4. Acceptable use
You agree not to:
- Use the platform for unlawful, fraudulent or harmful purposes.
- Post false, defamatory, hateful, discriminatory or misleading content.
- Submit business listings for businesses you do not own or are not authorised to represent.
- Scrape, copy or redistribute course content, the Business Registry, or other content without permission.
- Attempt to interfere with the platform's security or normal operation.
We may suspend or remove accounts and listings that breach these rules.
5. Memberships and billing
- Membership tiers and prices are shown on our website at the time of purchase.
- Payments are processed by Paystack and Netcash. By subscribing you authorise recurring billing for the chosen tier until you cancel.
- Prices may change. We will give you at least 30 days' notice by email before any change affects your account.
- Cancellation and refunds are governed by our Cancellation Policy and Refund Policy.
6. Business Registry
- You may only list businesses you own or are authorised to represent.
- You are responsible for the accuracy of your listing, including contact details, services and location.
- We may edit, hide or remove a listing that contains false, misleading, illegal, or offensive content, or that infringes the rights of others.
- A listing in the Registry is not an endorsement of the business by Grow South Africa, and customers transact with listed businesses at their own discretion.
7. Courses
- Course content (including videos, lessons, workbooks, downloadable plans) is licensed to you for personal, non-commercial use only. You may not redistribute, resell, or republish it.
- All intellectual property in the courses remains the property of Grow South Africa or its content partners.
- We may update or improve courses. Material removals will be communicated to enrolled learners.
8. Tours and Events in South Africa
The following terms apply to all paid Tours, Events, training days and community activations.
- Booking and payment: a booking is confirmed only once full payment (or the agreed deposit) has been received. Pricing includes only what is listed on the booking page; flights, visas, personal expenses and gratuities are excluded unless stated.
- Participant responsibilities: you must arrive on time, follow safety briefings and the lawful instructions of guides and operators, treat other participants and staff with respect, and disclose any medical condition or accessibility need that may affect your participation.
- Health and fitness: some activities require a minimum level of fitness or mobility. It is your responsibility to assess this honestly and to consult a doctor if in doubt.
- Insurance: we strongly recommend that you take out travel and personal accident insurance for all multi-day tours. We are not responsible for personal losses that should be covered by insurance.
- Indemnity and liability: participation in tours and outdoor activities carries inherent risk. To the fullest extent permitted by law, you participate at your own risk and indemnify Grow South Africa, its directors, employees and operating partners against claims for injury, loss or damage that are not the result of our gross negligence or wilful misconduct.
- Third-party operators: we may use independent operators (transport, accommodation, guides, activity providers). We select these partners carefully but are not liable for their acts or omissions beyond what is required by South African consumer law.
- Image and likeness: photos or video taken during tours and events may be used by Grow South Africa for marketing in line with our Privacy Policy. Tell the guide on the day if you do not wish to be photographed.
- Conduct: we reserve the right to remove any participant whose behaviour endangers others, breaks the law, or seriously disrupts the experience, without refund.
- Changes and cancellations: see our Cancellation Policy.
9. Road to Wellness and Prosperity Card
- The Card programme is a community programme operated in partnership with third parties. Specific Card terms (issuing fees, usage rules, restricted spending categories) are provided when you apply.
- Activation and issuing fees become non-refundable once the physical card is printed and dispatched.
10. User-generated content
Where you submit content (a business listing, a story to Million Histories, a workbook response shared with us, a review, or a contact submission), you grant Grow South Africa a non-exclusive, royalty-free licence to host, display and use that content for the purpose of operating and promoting our services. You retain ownership of your content and are responsible for ensuring you have the right to share it.
11. Intellectual property
The Grow South Africa name, logo, website design, course materials, photography and written content are the property of Grow South Africa or our licensors and are protected by copyright and trademark law. You may not use them without prior written consent.
12. Disclaimers
Our services are provided on an "as is" and "as available" basis. While we work hard to keep the platform accurate, secure and available, we do not warrant that it will be uninterrupted, error-free, or that any specific outcome (financial, business or personal) will result from using our content.
13. Limitation of liability
To the fullest extent permitted by law, Grow South Africa's total liability to you for any claim arising out of or related to these Terms or your use of our services is limited to the amounts you have paid to us in the 12 months preceding the claim. We are not liable for indirect, incidental, special or consequential losses (including loss of profit, data, opportunity or goodwill).
Nothing in these Terms limits any right you have under the South African Consumer Protection Act or other mandatory law.
14. Termination
You may close your account at any time by emailing us. We may suspend or terminate access for breach of these Terms or where required by law. Provisions that by their nature should survive termination (such as intellectual property, indemnity, and limitation of liability) will continue to apply.
15. Governing law and disputes
These Terms are governed by the laws of the Republic of South Africa. The parties will attempt to resolve any dispute amicably first. Failing that, the dispute will be submitted to the jurisdiction of the South African courts.
16. Changes
We may update these Terms from time to time. The "Last updated" date at the top reflects the latest revision. Continued use of the platform after changes are posted constitutes acceptance of the updated Terms.
